To the Sheriff of the said County of Hampshire or either of his
Deputies, or any of the constables of the Town of Conway
within the same County.
GREETING.
IN the Name of the Commonwealth of Massachusetts, you are required to attach
the
Goods or Estate of Elisha Frary of Whately in the
County aforesaid Yeoman
to the value of Ten Pounds and for Want
thereof, to take the Body of the said Elisha
(if he may be found in your Precinct) and him safely keep, so that he may
be had before me John Williams Esq. one of the Justices of the Peace
for the County aforesaid, at any Dwelling House in Deerfield in sd County on
Monday
the sixth Day of July next at two of the Clock,
in the afternoon ; then and there to answer to John Wing of Conway aforesaid
Yeoman in a Plea of Trespass upon the Case for the said
Elisha at Conway aforesaid, by his promissary Note, with his own pro-
per Hand subscribed, Dated March 19th 1789, for Value receivd
promised the said Wing to pay to him or his Order the Sum of two
Pounds, sixteen Shillings, in Money or neat Cattle by the first
Day of May then next, with Interest (incurring from ye Date of said Note) (for
the Same untill
paid -- yet the said Elisha hath did not pay the Contents of
said Note, either in Money or neat Cattle as aforesaid by the
Time aforesaid, altho the said John was ready at the Time aforesaid
at Conway aforesaid. to recieve the same according to the Tenor of
said Note, neither hath he ever since paid the Same, nor any
Part thereof (altho, he hath often been thereto requested and demanded --
But he wholly neglects to do it
To the Damage of the said John Wing
(as he saith) the sum of Four Pounds
as shall then and there be made to appear, with other due Damages. Hereof fail
not, and
make due return of this Writ, and your Doings therein, unto myself, at or before
the said
Sixth Day of July Dated at Deerfield
aforesaid, the seventeeth Day of June in the Year of
our Lord, one thousand seven hundred and eighty Nine
