This Indenture made the third day of August One thousand Six hundered
Nintie Nine Between John Stebbins with Dorithy his Wife of Derefeild in ye County of Hampshire
within the Province of ye Massachusetts Bay in New England on the one pt & Eliezer Hawks of Derefeild
aforesd on the other pt wittnesseth that the sd Jnē Stebbins with Dorithy his Wife for Lawfull Rea
=sons them thereunto Moveing & for & in consideration of ye Sum of fourteen pounds five shill
=ings already Received of which Sum they do hereby Exonerate & Discharge ye sd Elieze Hawks
his heir Executor or Assignes any Further payment hath cleerely given granted Bargained
alianated & passed over by these pesents Doth cleerely give grant Bargaine alienate & pass
over Unto Eliezer Hawks aforenamed & to his heir Executor or Assignes & to his & to their use
forever a Certaine pesell of Land within the Townshipp of Derefeild aforesd in that tract of Land
comonly called Stebbins Meadow abutting on the bend of the hill on highway Southeast & on ye
River Northwest Bounded by Land of James Browns Southwest & by ye sd Jnē Stebbins his Own
Land Northeast containeing by Estimation Seven acres & thirtie rod more or Less, In all wch
pesell of Land with all its peveledges & appurtenances thereon or thereto belonging the sd John
Stebbins with Dorithy his Wife Doe for themselves their heir Executor administrator & Assignes
absolutely utterly & for ever remitt remise & Relinquish all & any former Right to title power
claime interest or interest's in ye pemises & appurtenances apperteineing or belonging to the
aforesd Jnē Stebbins or Dorithy his Wife their heir Executor & administrator or Assignes Yielding
giveing granting & Sirrendering ye sd Right title power claime & interest in ye sd Land with
its preveledges & appurtenances thereon or thereto belonging to ye aforenamed Eliezer Hawks
To have and to hold to him & to his heir Executor & Assignes forevermore; And ye sayd
Jnē Stebbins with Dorithy his Wife Doe hereby Covenant & agree for themselves their heir Ex
ecutor administrator or Assignes to & with the the sd Eliezer Hawks his heir Executor & Assigne
that they have full power & Lawfull Authoritie to grant Bargaine & alienate ye pemises with
their appurtenances & that the sd Eliezer Hawks & his heir Executor or Assignes shall & may
from tyme to tyme & at all tymes Lawfully quietly & peaceably Have, use possess & injoy ye
sd Land with its appurtenances without any Let trouble Eviction Ejection Expulsion
or Molestation from or by the sd Jnē Stebbins or Dorithy his Wife their Heir Executor ad
=minestrator or Assignes or from or by any other person or persons clameing by from
or under them or any of them their privitie or procurement or otherwise by any per
=son or persons whatsoever; Alsoe the sd Jnē Stebbins with Dorithy his Wife their Heir
Executor administrator or Assignes Doe Covenant & agree to & with the sd Eliezer
Hawks his heir Executor or Assignes that the sd Land with its appurtenances shall be
& is discharged & freed from all manner of former or other Bargaines Sales titles
of inheritances Leases Mortgages Anuities fines joynt dowres Recognezances judgemts
Condemnations, Executions instrusions or any other incumbrance or intanglement
whatsoever Warrenting & by these pesents Ratiefieing the pemises with their appurte
=nances & Every part thereof as a good Sure & Lawfull Estate in ffee Simple wth out
any Revertion or Remainder to the sd Eliezer Hawks his heir Executor & Assigns for ever
& which hee or they may Enroll & Record to himself his heir Executor & Assignes by deed
Record or any other confirmation according to Law; Finnally to do act perform
& make any Further act or thing sine scoffement as by Learned Counsell in the
Law shall be advised devised or Required for the more sure makeing of the
premises with all their appurtenances to be & Enure to be to the Only proper
use & behoofe of the sd Eliezer Hawks his heir Executor or Assignes for Ever, as alsoe
to give Livirie & Seizer of the aforementioned Land with its preveledges &
appurtenances & alsoe all writeings or Evedences touching & concerneing the
pemises Unto the sd Eliezer Hawks his heir Executor & Assignes which he or they
shall & may freely quietly & peaceably possess & injoy the pemises with all
peveledges
& appurtenances without any Let trouble fraiude Eviction Ejection disturbance
or Molestation from or by the sd Jnē Stebbins or Dorithy his Wife their heir Executor
adminestrator or Assignes or any other person or persons claimeing or challing

Documents of this sort are filled with many lines of the legal language common in the 17th century. This is a land transfer, or sale, of a parcel of land south of the village of Deerfield in the Stebbins Meadows amounting to seven acres and thirty rods, more or less. The principals are the buyer, Eliezer Hawks (1655-1727), who pays fourteen pounds, five shillings, and the sellers, John Stebbins (1647-1724) and his wife, Dorothy (alive 1733). John Stebbins fixes his signature to the document as do the two witnesses, Samuel Partridge and Nathaniel Sutlief, but Dorothy Stebbins is unable to write and makes "her Marke."
