COMMONWEALTH OF MASSACHUSETTS.

FRANKLIN, SS.

To the Sheriff of our said county of Franklin, or either of his Deputies, or the Constables of the town of Montague within our said county or any or either of them, GREETING.

WHEREAS Orlando Ware of Deerfield in the County aforesaid, Trader, on the fifteenth day of Sept. 1818 before Wm Stodd Williams Esq. one of the Justices of the Peace for our county aforesaid, recovered judgement against Daniel Burnham of Montague aforesaid, Yeoman, for the sum of six dollars and thirty cents, debt or damage, and two dollars and eighty three cents charges of suit, as to us appears of record, whereof execution remains to be done:

We command you, therefore, That of the money of the said Burnham or of his goods or chattels within your precinct, at the value thereof in money, you cause to be levied, paid and satisfied unto the said Ware the aforesaid sums, being nine dollars and thirteen cents in the whole; and also that out of the money, goods or chattels of the said ----you levy fifty cents for this and a former writ, together with your own fees. And for want of such money, goods, or chattels of the said Burnham to be by him shewn unto you, or found within your precinct, to the acceptance of the said Ware for satisfying the aforesaid sums: We command you to take the body of the said Burnham and him commit unto our gaol in Greenfield: And we command the keeper thereof, accordingly to receive the said Burnham into our said gaol, and him safely to keep until he pay the full sums abovementioned, with your fees, or that he be discharged by the said Ware the creditor, or otherwise by order of law. Hereof fail not, and make return of this writ, with your doings therein, unto our said Justice, within sixty days next coming. Witness our said Justice, at said Deerfield the seventh day of August in the year of our Lord, one thousand eight hundred and nineteen

Orlando Ware (1779-1860) was a storekeeper ("trader") in Deerfield, Massachusetts, from 1802 to 1831. His account books survive in the PVMA library for the years 1803 to 1830. Many of his customers, as was the pattern in the 18th and 19th centuries, did not pay their bills regularly. At times, legal action had to be taken to clear the debts. Daniel Burnham of Montague owed Mr. Ware $6.30. The legal fees for the court action amounted to $2.83 making a total of $9.13 demanded of Mr. Burnham on the seventh day of August 1819. The form used was issued by the Commonwealth of Massachusetts with the particulars of this case filled in by Dr. Williams.
